US Supreme Court declines to hear Upstate SC river pollution lawsuit

SUNSET — The United States Supreme Court has decided not to hear an appeal by a Pickens County wedding and events venue in a case brought by multiple environmental groups.

The Supreme Court denied writ of certiorari to Arabella Farm, which had the support of the South Carolina Department of Health and Environmental Control (DHEC), in its argument that environmental groups lacked standing to sue the farm over alleged river pollution under the Clean Water Act. The farm had argued environmental groups didn’t have grounds to sue because the state had already started an enforcement against it for failing to obtain permits before beginning to clear 20 acres of land.

Now the case will return to the U.S. District Court in Greenville to argue the merits of the lawsuit and any potential penalties against the farm.
