On behalf of the SC Coastal Conservation League, we are appealing OCRM's issuance of a permit to construct a cartpath across public trust tidelands to a small marsh island in Mt. Pleasant, Charleston County. The project does not comply with OCRM regulations and we believe that this permit could lead to evading the regulatory requirements and the development of small marsh islands.
We successfully ended this case when the developer agreed to limit the use of the island to recreational activities allowed under Conservation Open Space zoning; agreed to prohibit habitable structures on the island; agreed to maintain natural vegetated buffers around the island; and agreed to limit the use of the cartpath structure to foot and lawnmowers for maintenance. The developer will be bound to these limitations through a deed restriction on the property recorded in Charleston County and the island will remain an undeveloped recreational area.
